This Privacy Policy explains how ERNESTO STUDIO PHOTOGRAPHY LLC, doing business as Ernesto Studio and Ernesto Studio Miami (“Ernesto Studio,” “we,” “us,” or “our”), collects, uses, retains, and discloses personal information when a person visits ernestostudio.com; requests information; schedules a consultation; purchases services; participates in a session or event; uses a digital gallery; communicates with us by telephone, email, WhatsApp, or SMS; or interacts with our social-media accounts.
2. Information We Collect
2.1 Information provided directly
Identification and contact information, such as name, mailing address, email address, and telephone number.
Information about the contracting customer, participants, parents or legal guardians, and information needed to coordinate sessions involving minors.
Booking information, dates, locations, preferences, packages, additional services, photograph selections, and communications with the studio.
Content and files supplied by a customer, and photographs, audio, video, and other materials captured while providing services.
Payment and billing information. Payments may be processed by third parties; we generally do not store complete payment-card numbers.
Communication preferences and consent records, including the date, time, source, form, IP address, and exact consent language when applicable.
2.2 Information collected automatically
When the website is used, we may receive an IP address, device and browser type, pages visited, date and time, referring website, cookie identifiers, and similar information. Squarespace may collect this information, together with analytics, advertising, or social-media services if those services are enabled.
2.3 Information received from third parties
We may receive information from booking platforms, payment processors, digital-gallery providers, communications providers, social networks, family members coordinating a session, and other vendors used to provide our services. A person who gives us another individual’s information represents that they are authorized to do so.
3. How We Use Information
Respond to inquiries, schedule appointments, and prepare proposals or contracts.
Provide, personalize, and deliver photography, video, makeup, wardrobe, album, gallery, and related services.
Process payments, administer balances, prevent fraud, and maintain accounting records.
Send confirmations, reminders, operational updates, and communications related to a purchase or booking.
Send email or SMS promotions when the required consent or other lawful basis exists.
Operate, secure, analyze, and improve the website, services, and customer experience.

4. Photographs, Videos, and Minors
Photographs and videos are captured and delivered to perform the customer contract. Because many services involve minors, bookings and related permissions must be completed by an adult with legal authority. The website is not directed to children under 13 and is not intended to collect their personal information directly without the involvement and authorization of a parent or legal guardian.
The use of identifiable images for a portfolio, advertising, social media, contests, publications, or promotion requires a separate, clear, and verifiable model or image release from an authorized adult.
5. Email, Telephone, WhatsApp, and SMS Communications
We may send communications regarding inquiries, bookings, payments, sessions, selections, deliveries, and support. Marketing communications will be sent only as permitted by applicable consent and law. Consent to receive SMS marketing is not a condition of purchasing any goods or services.

6. How We Disclose Information
We may disclose information only as reasonably necessary to:
Vendors that host the website; manage bookings; process payments; deliver galleries; print products; store files; send email or messages; or provide analytics, security, or technical support.
Photographers, videographers, makeup artists, stylists, assistants, laboratories, venues, and other collaborators needed to perform the purchased service.
Authorities, advisers, or third parties when needed to comply with law, protect rights, or respond to valid legal process.
A successor entity in a merger, reorganization, or asset sale, subject to reasonable safeguards.
Other third parties at the individual’s direction or with the individual’s authorization.
We do not sell or rent personal information. We do not share mobile numbers, SMS opt-in information, or consent records with third parties or affiliates for their own marketing or promotional purposes. This restriction does not prevent disclosure to service providers acting solely on our behalf to deliver messages, operate the program, or comply with law; those providers may not use the information for their own marketing.
